【婚内出轨是否涉及犯罪？】

? 出轨，一般是指：夫妻在婚姻存续期间，夫或妻一方与婚外异性发生性关系。婚内出轨并不仅仅会引发社会道德谴责，严重者可能构成犯罪，是要被追究刑事责任的。

【出轨＆刑事责任】


有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
 
明知是现役军人的配偶而与之同居或者结婚的，处三年以下有期徒刑或者拘役。
 
 
【法律主要规定的不忠行为】


 
  
  
通奸
 		  
指偶尔与婚外异性发生性关系的行为。
 		 
 
  
同居
 		  
最高法司法解释将此定义为“有配偶者与婚外异性，不以夫妻名义，持续、稳定地共同居住。”
 		 
 
  
重婚
 		  
有配偶者与他人以夫妻名义共同居住生活，且周围的人也认为其为夫妻，则构成重婚罪;此外，明知他人有配偶还为上述行为的，同样构成重婚罪。
 		 
  
 

⚠：构成重婚罪，除需要依据刑法的规定承担刑事责任外，在民事上，婚姻中的无过错方在离婚时仍可主张损害赔偿。

【出轨＆赔偿】

《婚姻法》第四十六条规定，有下列情形之一，导致离婚的，无过错方有权请求损害赔偿：


 
  
  
? 重婚的；
 		 
 
  
? 有配偶者与他人同居的;
 		 
 
  
? 实施家庭暴力的;
 		 
 
  
? 虐待、遗弃家庭成员的。
 		 
  
 

⚠：根据上述规定，我国婚姻法规定离婚损害赔偿制度，因为一方重婚或者有配偶者与他人同居而导致离婚的，无过错方可以请求离婚损害赔偿。

一方出轨导致夫妻感情破裂离婚的，在离婚分割夫妻共同财产时，可以由双方自由协商决定分割。双方不能协商一致分割的，要走起诉离婚程序的，受害方可以主张多分共同财产。

【出轨＆赔偿范围】

? 离婚损害赔偿包含物质损害赔偿和精神损害赔偿。

物质损害赔偿主要是财产损害赔偿，是赔偿离婚过错方造成的实际财产损失，过错方对此应当全部赔偿。

精神损害赔偿主要是对受害方进行的精神抚慰，在确定离婚损害赔偿的数额时，应当考虑一些因素：

一是要考虑赔偿数额应当能够抚慰婚姻无过错方所受到的心灵上的创伤和精神上的痛苦，且要以受理诉讼的人民法院所在地的基本生活水平为准;

二是要考虑过错方的经济负担能力，体现出对过错方的有效制裁;

三是要考虑过错方侵害的过程程度、手段、场合、后果和影响等具体情节确定其赔偿责任，以保护婚姻当事人的合法权益。

俞渝，李国庆，这两个名字几乎霸占了2019年10月24日这天所有新闻板块的头条，但是从律师的角度来看，这一尚未落幕整场的闹剧核心只有两件事，一是离婚，二是利益。
 
 
 
一、为何要将离婚放在第一位？
 
 
 
可能更多观众的看点放在利益以及香艳的八卦上，更认为导致今天这种局面的是利益分配不均，换个角度，如果俞渝与李国庆现在感情甜蜜胜似新婚夫妻，还会有这些问题吗？就如一般的离婚案件一样，争夺抚养权也好，分财产也罢，其实都是夫妻感情破裂之后所有问题的具现化。
 
 
 
说回案件本身，我们可以从李国庆的描述中得知，俞渝在这一次的诉讼当中表示不愿意离婚，那么因为是第一次诉讼，法院判决双方不离婚的可能性非常大，李国庆需要六个月之后再起诉，而这期间俞渝方能做的事情太多，李国庆已经等不起了。所以李国庆方通过微博引发了大规模的舆论战。
 
 
 
为何要搞舆论战？因为这种情况下俞渝为了争取舆论自会反击，而反击的内容至少能证明两人感情已经破裂，一对夫妇已经撕到这种地步，法官还认为双方感情没有破裂，只怕于法于情于理都说不过去，法官也承受不住舆论的压力。至此，李国庆方至少可以达到“离婚”的目的。
 
 
 
二、利益
 
 
 
说完离婚，我们再来细谈整出戏的重点：“财产”。
 
  
 
第一，俞渝方指出李国庆方拿走了现金一亿三。这里的现金指的应该是存款、基金等等。按照《婚姻法》的规定，存款、基金属于夫妻共同财产，离婚时需要进行分割，分割起来也比较简单。俞渝很聪明的明确了李国庆名下依然有需要分割的夫妻共同财产，双方下一步也就是要求查彼此的银行流水，是否经得起查，就只有双方自己心里清楚了。
 
   
 
第二、股权问题。北京当当网信息技术有限公司，注册资本27000万元人民币，实缴资本27000万元人民币，目前，俞渝持股64.21%，为第一大股东，李国庆持股27.5%，为第二大股东，可2010年李国庆持股还是38.9%，俞渝仅仅持股为4.9%，从数字就能看出这几年当当内部股权争夺有多激烈，但也从侧面印证，到目前为止，俞渝作为掌握话语权的人，没有让当当因为他们夫妻的事情垮下去，要知道，多少公司都是死于股东内部争权。
 
 
 
说回股权分割，因为股权是一种特殊的“权利”，除了收益，更直接影响股东对公司的话语权和控制权，所以股权的转让比起一般财产要更为复杂，因为一旦股权持有人换了，整个公司的老板可能就也换了，可能会影响到公司的运作，股权转让需要对其他股东负责，对员工负责，对企业本身负责。
 
 
 
根据《婚姻法司法解释二》第十六条的规定，股权的转让，需要过半数股东同意并且其他股东明确表示放弃优先购买权；过半数股东不同意转让，但愿意以同等价格购买该出资额的，人民法院可以对转让出资所得财产进行分割；过半数股东不同意转让，也不行使优先购买权，视为其同意转让。
 
 
 
所以说，俞渝最聪明的就是，在知道自己有可能要离婚之前，将当当网的股份争取过来，实际掌控住了当当，当当网的微博几次发声也都是站在俞渝这边，至少说明这么多年她的努力、能力大家也看在眼里，当当内部的选择俞渝的可能性远比李国庆要大，李国庆最终可能只能拿到相应的股权折价，如果其确实已经拿走了一亿三千万，那么甚至有可能俞渝连折价都不需要支付过多。
 
 
 
第三、转移财产，给小三买房等。
 
 
 
李国庆方主张俞渝转移财产，但俞渝作为当当网的第一大股东，其名下的公司也不计其数，想要在这负责的公司账务往来下说明俞渝转移财产，难度可想而知。
 
 
 
俞渝方指责李国庆给男小三、小四买房，这一点也很难证明，因为必须有证据证明李国庆与他人有不正当关系，并且证明在这种关系下李国庆无偿赠与了小三房子，成功了那么俞渝可以要回房子或者要求李国庆赔偿损失。
 
 
 
结合以上的分析，就知道这次离婚案件中的财产分割十分复杂，需要双方向法官说明的内容过多，所以舆论也就成为了双方的工具之一。最新消息，李国庆方要求当当25%的股份，但目前来看俞渝方同意的可能性比较小。

更有人觉得孩子也是家庭成员，也有必要分配到财产，那么离婚时，孩子可以参加财产分割吗？
 
 
 
夫妻财产分割是基于，夫妻双方在婚姻存续期间基于工资、利息、奖金、租金、股票收入等收入的不动产或货币财产。
 
 
 
离婚时，需要夫妻双方对夫妻共同财产进行划分，分割是夫妻二人的事，与第三人无关。
 
 
 
当然，如果夫妻双方和成年子女生活在一起，他们应该在分割夫妻共同财产之前先整理属于子女的财产。这种情况实际上是家庭财产的分割，不属于夫妻共同财产分割的范畴。
 
 
 
因此，已经成年的孩子是不可以分割夫妻共同财产的，这一点一定要明晰。
 
 
 
一般来说，家庭财产是由夫妻双方在婚姻存续期间，通过劳动积累下来的。
 
 
 
而未成年人尚未参加劳动，没有经济收入，所以，在父母离婚时，未成年人无权分割家产。
 
 
 
子女无权分割父母的共同财产，同样，夫妻双方在离婚时，也不能分割属于未成年人的财产。
 
 
 
根据法律规定，以下财产为未成年人个人所有：
 
 
 
获得的奖金，如因成绩优异而获得的奖学金，因见义勇为而获得的政府奖励等。
 
 
 
接受赠与而得的财产。赠与人明确表示将赠与物赠给未成年人个人的，应当认定该赠与物为未成年人的个人财产。
 
 
 
继承遗产而得的财产。按照继承法规定，爷爷奶奶外公外婆可以通过立遗嘱的方式让孙子女、外孙子女继承自己的遗产。
 
 
 
人身损害而得的财产。未成年人因健康、身体遭受侵害致残的，有权要求加害人等赔偿义务人赔偿，包括赔偿医疗费、护理费、营养费、残疾赔偿金、后续治疗费、精神损害抚慰金等。其中的营养费、残疾赔偿金、精神损害抚慰金等属于被侵害的未成年人个人财产。
 
 
 
享有智力成果而得的财产。
 
 
 
同时，父母作为监护人，有责任保护被监护人的合法权益，除为被监护人的利益外，不得损害被监护人的财产。
 
 
 
因此，父母不允许处置未成年人拥有的个人财产，也不允许在婚姻期间或离婚期间强行占有这些财产。

在法院受理的离婚案件中，大部分都会涉及到财产纠纷。不管是分配方式、财产数额都是当事人最头疼的问题。
 
 
 
我国《婚姻法》明确规定，夫妻双方不得在离婚时隐藏、转移、变卖、毁损夫妻共同财产或伪造共同债务。
 
 
 
如果在分割夫妻共同财产时，一方隐藏、转移、变卖、毁损夫妻共同财产或伪造债务，可以要求对方少分财产或是不分。
 
 
 
离婚后，如果发现对方有上述行为存在，当事人可以向法院提起上诉，请求再次分割共同财产。
 
 
 
在实践过程中，一般应把隐藏、转移、毁损的财产，对应另一方的应得的份额以及其他夫妻共同财产折抵。
 
 
 
不足折抵的，差额部分由隐藏、转移、变卖、毁损财产的一方折价补偿对方。
 
 
 
法律明确规定了一方转移财产的赔偿情况，但法律需要以证据说话。
 
 
 
根据“谁主张谁举证”的原则，未转移财产的一方需要证据来证明对方转移了财产，转移了多少。如果无法举证，很有可能会承担不利的法律责任。
 
 
 
在生活过程中，许多家庭地位低下的当事人在离婚分割财产时，常处于收集证据的劣势。
 
 
 
而且目前很多家庭财产情况都较复杂，除了住房、存款还有股权，基金等财产，如果受害方对新型的理财方式不了解，或者根本就不知情，就无法完成搜集证据的任务。
 
 
 
当客观事实无法被证明时，受害者也只能看着本属于自己的财产归属他人。
 
 
 
那怎样才能收集对方转移财产的证据呢？
 
 
 
受害者在起诉前应该积极的搜集共有财产的证据，比如，夫妻共有的：公司股东出资证据;公司相关财务报表;存折的开户行、账号;炒股账号;房屋所有权证;其它夫妻共有财产的发票等。
 
 
 
并对现金及贵重物品妥善保管，必要时可以申请财产保全。

A2：对于夫妻双方在婚姻关系存续期间经申请获取的宅基地使用权，因宅基地属于集体所有，故宅基地使用权不属于夫妻共同财产，在夫妻离婚时，该宅基地不能作为夫妻共同财产进行分割。

A5：夫妻双方在离婚时对宅基地使用权归属发生分歧的，属于土地使用权争议，应当由相关行政部门进行处理，而不属于法院处理离婚纠纷案件的审理范围，故离婚双方无权请求审理离婚纠纷的人民法院划分宅基地使用权。
