A1:一夜情、通奸、嫖娼等等行为，都不算过错行为，在离婚财产分割时一般会不会照顾受害方要视具体情况而定。

 

Q2：什么是过错行为？

A2：(1) 重婚，必须是满足过错方与第三者达到结婚的状态，也就是存在婚姻状态。(2) 有配偶者与他人同居，有配偶者与婚外异性，不以夫妻名义，持续、稳定地共同居住。(3)家庭暴力，依据最高人民法院的司法解释，是指：行为人以殴打、捆绑、残害、强行限制人身自由或者其他手段，给其家庭成员的身体、精神等方面造成一定伤害后果的行为;持续性、经常性的家庭暴力，构成虐待。(4)虐待遗弃家庭成员的。必须是长期的虐待遗弃家庭成员的行为，如，生病不给治、不给饭吃、不照顾等等。

每对夫妻在离婚的时候都要对财产进行划分，财产分割也会引起不少争执。

 

更有人觉得孩子也是家庭成员，也有必要分配到财产，那么离婚时，孩子可以参加财产分割吗？

 

夫妻财产分割是基于，夫妻双方在婚姻存续期间基于工资、利息、奖金、租金、股票收入等收入的不动产或货币财产。

 

离婚时，需要夫妻双方对夫妻共同财产进行划分，分割是夫妻二人的事，与第三人无关。

 

当然，如果夫妻双方和成年子女生活在一起，他们应该在分割夫妻共同财产之前先整理属于子女的财产。这种情况实际上是家庭财产的分割，不属于夫妻共同财产分割的范畴。

 

因此，已经成年的孩子是不可以分割夫妻共同财产的，这一点一定要明晰。

 

一般来说，家庭财产是由夫妻双方在婚姻存续期间，通过劳动积累下来的。

 

而未成年人尚未参加劳动，没有经济收入，所以，在父母离婚时，未成年人无权分割家产。

 

子女无权分割父母的共同财产，同样，夫妻双方在离婚时，也不能分割属于未成年人的财产。

 

根据法律规定，以下财产为未成年人个人所有：

 

获得的奖金，如因成绩优异而获得的奖学金，因见义勇为而获得的政府奖励等。

 

接受赠与而得的财产。赠与人明确表示将赠与物赠给未成年人个人的，应当认定该赠与物为未成年人的个人财产。

 

继承遗产而得的财产。按照继承法规定，爷爷奶奶外公外婆可以通过立遗嘱的方式让孙子女、外孙子女继承自己的遗产。

 

人身损害而得的财产。未成年人因健康、身体遭受侵害致残的，有权要求加害人等赔偿义务人赔偿，包括赔偿医疗费、护理费、营养费、残疾赔偿金、后续治疗费、精神损害抚慰金等。其中的营养费、残疾赔偿金、精神损害抚慰金等属于被侵害的未成年人个人财产。

 

享有智力成果而得的财产。

 

同时，父母作为监护人，有责任保护被监护人的合法权益，除为被监护人的利益外，不得损害被监护人的财产。

 

因此，父母不允许处置未成年人拥有的个人财产，也不允许在婚姻期间或离婚期间强行占有这些财产。

离婚时，宅基地可以作为共同财产分割吗？

 

 

夫妻双方决定离婚了，分割财产时，宅基地是否可以作为夫妻共同财产进行分割？

 

案例简介：

 

2002年，李雷与韩梅梅办理了离婚登记，二人确立婚姻关系。

 

2003年，韩梅梅为李雷生下一女。

 

李雷嫌对韩梅梅生下的是女儿一直不满，于是二人经常发生争吵。

 

韩梅梅忍无可忍选择起诉离婚，并要求分割婚后共同财产。

 

2004年法院对二人的离婚作出终审民事判决。

 

可李雷不服，以涉案宅基地系家庭共同财产，不应作为夫妻共同财产予以分割为由，提出上诉。

 

案件结果：

 

法院二次审理认为，双方对宅基地所有权的争议不属于法院审理的民事法律关系范围。

 

一审法院将所涉宅基地的所有权视为夫妻共同财产，二审法院将宅基地使用权作为夫妻共同财产予以分割均属适用法律错误。

 

据此法院依照《民事诉讼法》相关规定，此次判决撤销原一审、二审对宅基地权属的判决。

 

判决后，当事人应向宅基地权属争议应当向人民政府土地管理部门提出。

 

律师说法：

 

夫妻双方在婚姻关系存续期间内，所获得的财产大部分是夫妻双方的共同财产。

 

但是，夫妻共同财产也仅包括一方个人享有所有权的财产。

 

根据《中华人民共和国土地管理法》第八条规定：“农村和城市郊区的土地，除由法律规定属于国家所有的以外，属于农民集体所有;宅基地和自留地、自留山，属于农民集体所有”。

 

据此，夫妻双方在婚姻存续期间申请取得的宅基地使用权，由于宅基地属于集体所有，不属于夫妻共有财产。离婚时，宅基地不能分割为夫妻共同财产。

 

同时《土地管理法》第十六条规定：“土地所有权和使用权争议，由当事人协商解决;协商不成的，由人民政府处理。当事人对人民政府处理决定不服的可以自接到处理决定通知之日起30日内，向人民法院起诉”，此处的诉讼是行政诉讼，而不是民事诉讼。

夫妻双方在离婚时肯定避免不了要分割共有财产，但有些夫妻的财产在国外，这种情况下应该怎么分割？

 

夫妻双方离婚时，法院只能对夫妻共同财产中属于中国的部分进行分割。当事人可以在当地提起民事诉讼或将国外财产变卖、折现后再归国，以中国法律进行分割。

 

那涉外离婚如何让办理，又有哪些办理方式？

 

根据我国现行的《婚姻法》离婚只有两种途径，一是协议离婚，二是诉讼离婚。

 

1、协议离婚：在中国办理结婚的登记的夫妻，如果一方在国内，另一方在国外。双方自愿离婚，并对子女扶养、财产分割等进行明确协商，没有任何分歧，双方可以共同到民政局办理离婚登记。

 

需要注意的是，离婚手续必须本人亲自办理，不可以委托办理。

 

2、诉讼离婚：如果一方不能亲自办理离婚登记（如在国外），或者双方对离婚事项有争议的，夫妻双方任何一方都可以向国内一方户籍所在地或常住地提起离婚诉讼，通过法院判决解除婚姻关系。

 

在涉外离婚中，不论是双方自愿离婚，还是一方执意要离婚，离婚程序最好选择通过诉讼程序解决，由我国法院做出相应的判决。

 

因为，有些国家只承认法院判决的离婚。

 

有些法院可以适用简易程序当场为双方办妥离婚手续，在双方达成一致的情况下，可以选择去法院办理相关简易程序。

 

同时，在涉外离婚诉讼中委托诉讼代理人需要注意以下两个问题：

 

①：离婚案中，有诉讼代理人的，仍应出庭（除本人不能表达意志外），确因特殊情况无法出庭的，应必须向人民法院提出书面意见。

 

②：外国人在人民法院起诉、应诉，需要委托律师代理诉讼的，必须委托中华人民共和国的律师。

2020新婚姻法-一方出轨离婚财产怎么分配？

 

有很多夫妻之间，因为没办法接受对方出轨而选择了离婚，那么在这种情况下离婚，离婚财产应该怎么分割？能否少分、不分财产或者要求净身出户呢？

 

一、一方出轨离婚财产怎么分割？

 

对于夫妻共同财产，根据《婚姻法》有关离婚财产分割的规定，应该遵循以下原则:

 

1、男女平等原则。在离婚财产分割上，夫妻双方有平等地分割共同财产的权利；

 

2、照顾子女和女方利益原则。可以在财产份额上给予女方适当多；

 

3、照顾无过错方的原则。如果另一方有以下情节之一，比如重婚或者有配偶者与他人同居导致离婚，无过错方可以请求离婚损害赔偿等。

 

所以对于一方出轨离婚财产如何分配，如果涉及重婚或者与他人同居的是可以请求离婚损害赔偿的。但若单纯出轨的话，只能诉求法院适当少分或者不分财产。

 

二、那什么情形下是可以少分或者不分财产的呢？

 

根据婚姻法相关规定：“离婚时，一方隐藏、转移、变卖、毁损夫妻共同财产，或伪造债务企图侵占另一方财产的，分割夫妻共同财产时，对隐藏、转移、变卖、毁损夫妻共同财产或伪造债务的一方，可以少分或不分。离婚后，另一方发现有上述行为的，可以向人民法院提起诉讼，请求再次分割夫妻共同财产。

 

但要注意的是夫妻在离婚财产分割上还需要注意财产是属于个人婚前财产还是夫妻共同财产，夫妻离婚只能对夫妻共同财产进行分割。

结婚就是把两个不熟悉的家庭通过婚姻变成一家人，而离婚就是把一家人拆散成两个家庭，所谓的拆散包括：房产、财产、存款等，都需要进行一个明确的划分。

 

那夫妻双方在离婚时，没有共同财产应该怎么分呢？

 

首先要明确什么是共有财产，共有财产是指夫妻之间对某项财产共同拥有所有权，如婚后夫妻二人的工资等都属于共有财产。

 

共同财产可分为按份共有和共同拥有：

 

①按份共有：是指两个人或两个人以上对款项按各自的份额分享权力。

 

按份共有的共有人按自己的份额分担义务，例如合伙企业是按照出资份额来享受或承担盈亏金额。

 

在处分共有财产时，双方应协商一致，一方不能私自处理共有财产，若不能协商处理，按照持有份额一半以上人的意见处理，但处理时不得损害其他共有人的利益。

 

同时，每个共有人有权将自己的份额分出或转让。但其他共有人在同等条件下，有优先购买的权利。优先购买权必须在规定的期限内行使，否则会丧失权利。

 

②共同共有：是指两个或两个以上的共有人对一份财产不分份额，但平等的享有所有权。主要形式是夫妻共有财产和家庭共有财产。对于这些财产，每个共有人都平等的享有所有权，没有权利、义务按份的区分。

 

如果夫妻双方在离婚时，没有共同财产需要分割，只需和其他离婚纠纷一样进行处理，仅对财产这块不需进行分割。

 

其他离婚纠纷在处理时，一般有两种形式：协议离婚、诉讼离婚。

 

协议离婚是双方对离婚达成一致，签订《离婚协议》，然后双方携带身份证、户口本、结婚证以及双方签署的《离婚协议》，到夫妻一方户口所在地的民政局办理离婚登记即可。

 

离婚时，会收回现有的结婚证，并发放离婚证。
